1. OUR ROLE: WE CONNECT, WE GIVE VISIBILITY, WE DO NOT SELL

TheLuxuryCrypto operates as a connection and visibility platform, not as a seller.

What sellers can do:

  • Publish listings directly on our platform

  • Give visibility to their existing listings on other platforms (Chrono24, forums, social media, etc.)

What we do NOT do:

  • We do not own, store, or handle any of the listed items

  • We hold no inventory

  • We are not a party to any sale and purchase agreement between buyer and seller

Our role is limited to:

  • Connecting the parties

  • Optionally, offering our Escrow service to secure the transaction

Important: For any transaction conducted outside our Escrow service, we have no involvement and disclaim all liability.

2. DEFINITIONS

3. ACCOUNT REGISTRATION

  • You must be at least 18 years old to use our Platform

  • You agree to provide accurate, current and complete information during registration

  • You are responsible for maintaining the confidentiality of your account credentials

  • We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity

4. DESCRIPTION OF SERVICES

🔹 Platform Access and Connection Infrastructure
TheLuxuryCrypto operates an exclusive digital ecosystem connecting vetted global dealers and verified high-net-worth investors. Users can review live asset allocations and initiate secure settlement procedures.

Fee Structure:
• Acquisition Allocation Fee (Buyer): Successfully completed transactions are subject to a 1% Allocation Fee, applied exclusively upon successful transaction closure. If the settlement is not completed, no capital is deployed.
• Liquidity Provision (Seller): Certified professional partners and private collectors benefit from a 0% Seller Commission, preserving 100% of the asset value.

🔹 The Escrow Service (TheEscrow)
We offer an integrated Escrow service to secure high-value transactions. This service ensures capital efficiency and security for both parties.
When activated:
• We act as a neutral deposit agent.
• We accept payments via institutional bank transfer and verified cryptocurrency assets, securely locking the funds.
• We hold the Buyer's payment until both parties confirm that the transaction criteria have been met.
• We release funds to the Seller only after the Buyer confirms receipt and satisfaction following the inspection period.

This service is subject to a separate Escrow Agreement which forms part of these Terms.

Important — Cryptocurrency Asset Settlement:
Cryptocurrency settlements are subject to market volatility. Once a transaction and its specific cryptographic deposit are initiated, the asset values may fluctuate. The transacting parties explicitly accept this risk. For traditional fiat bank transfers, funds are securely held in our escrow accounts with no fluctuation risk.

5. LISTING AND SELLING ITEMS

  • Sellers must have the legal right to sell the listed item

  • Listings must include accurate descriptions, photographs and any relevant documentation (serial numbers, certificates, etc.)

  • Sellers are solely responsible for the authenticity, condition and legality of their items

  • We reserve the right to remove any listing that violates these Terms or applicable laws

  • Professional sellers must comply with applicable consumer protection laws, including the right of withdrawal (14 days)

6. BUYING ITEMS

  • Buyers are responsible for verifying the authenticity and condition of the item before confirming receipt

  • If you use our Escrow service, you have the right to inspect the item before funds are released

  • If you purchase outside Escrow, the transaction is at your own risk

  • Import duties, taxes and customs fees are the Buyer's sole responsibility

7. THE ESCROW SERVICE

This service is designed to add security to transactions.

What we do:

  • Act only as a deposit agent

  • Hold funds in bank transfer or cryptocurrency

  • Release funds according to the agreed conditions

What we do NOT do:

  • We do not authenticate, inspect, store or ship items

  • We do not guarantee the authenticity, condition, or legality of any item

Requirements:

  • Both parties must complete identity verification before using Escrow

Fees:

  • Fees are clearly displayed before activating the service

  • Fees are non-refundable once the transaction is initiated

8. DISPUTES AND MEDIATION

  • We encourage users to resolve disputes directly and amicably

  • If you used our Escrow service, we offer mediation as a neutral third party

  • Mediation decisions are non-binding and parties retain the right to seek legal remedies

  • We may, at our discretion, hold funds for up to 30 days during dispute resolution

  • For transactions outside Escrow, we cannot intervene

9. LIMITATION OF LIABILITY

To the fullest extent permitted by law, TheLuxuryCrypto shall not be liable for:

  • The authenticity, condition, quality, or legality of any item listed on the Platform

  • Any acts or omissions of Sellers or Buyers

  • Shipping, damage, loss, or theft of items

  • Any indirect, incidental, or consequential damages arising from use of the Platform

  • Cryptocurrency volatility or market fluctuations

  • Any issues arising from transactions conducted outside our Escrow service

  • Force majeure events beyond our reasonable control

Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.

10. INTELLECTUAL PROPERTY

  • All content on the Platform (text, graphics, logos, images) is owned by or licensed to TheLuxuryCrypto

  • Users may not copy, modify, distribute, or reproduce any content without our written consent

  • By posting a listing, you grant us a non-exclusive license to display the content on our Platform

11. PRIVACY AND DATA

  • Our Privacy Policy explains how we collect, use and protect your personal data

  • By using the Platform, you consent to our data practices as described in the Privacy Policy

  • We use cookies as detailed in our Cookie Policy

12. TERMINATION

  • We may suspend or terminate your access to the Platform at any time, with or without cause

  • Upon termination, you remain liable for any ongoing transactions or obligations

  • We may retain your data as required by law or for legitimate business purposes

13. GOVERNING LAW AND JURISDICTION

  • These Terms shall be governed by the laws of England and Wales

  • Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales

  • This does not affect your statutory rights as a consumer under applicable law

14. CHANGES TO TERMS

  • We may update these Terms from time to time

  • The latest version will always be available on this page

  • Continued use of the Platform after changes constitutes acceptance
